MarKey Terms of Service

These Terms of Service ("Terms") govern your use of MarKey (the "Service"), operated by J.T. & Son's Development Group ("MarKey," "we," "our," or "us"). By creating an account or otherwise using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
1. The Service
MarKey is a mobile application that streams original short-form vertical video series ("Episodes," collectively "Content"). New episodes are released on a regular schedule. The first ten episodes of each series are available for free; subsequent episodes can be unlocked using virtual coins ("Coins") or by waiting 24 hours after the in-app release.
2. Eligibility
You must be at least 18 years old to use MarKey. By using the Service you represent that you are 18 or older and have the legal capacity to enter into this agreement.
If we discover that an account is held by someone under 18, we will close the account.
3. Your Account
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate and current information.
- You may not create multiple accounts to circumvent referral or coin limits.
- One person may have only one MarKey account.
We may suspend or terminate accounts that violate these Terms.
4. Coins, Purchases, and Refunds
4.1 What Coins Are
Coins are a virtual currency used inside MarKey to unlock episodes. Coins: - Have no real-world cash value outside the app. - Cannot be exchanged for cash, transferred between accounts, or refunded as cash. - May expire if your account is inactive for an extended period (we will provide reasonable notice before any expiration). - Are subject to change in price, granted amount, or unlock cost.
4.2 Purchases
Coin purchases are processed by Apple App Store (iOS) or Google Play (Android). All purchases are subject to Apple's and Google's terms, in addition to ours.
4.3 Refunds
Refunds are handled by Apple or Google according to their respective policies: - Apple refunds: https://reportaproblem.apple.com - Google refunds: https://play.google.com/store/account/orderhistory
We do not directly issue refunds for coin purchases. If you believe you were charged in error, contact Apple or Google support.
4.4 Coins Granted by Referrals
Coins granted via the referral program are promotional and: - Are non-transferable and have no cash value. - May be revoked if we detect fraudulent activity (bot signups, fake accounts, etc.). - Are subject to daily caps (currently 5 successful referrals per code per day). - Both the referrer and the new user must satisfy the program's fraud-prevention requirements (including phone verification and watching their first episode).
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to access another user's account.
- Use bots, scrapers, or automation to interact with the Service.
- Attempt to circumvent paywalls, copy-protection, or unlock mechanisms.
- Resell, redistribute, or commercially exploit the Content.
- Use the referral program fraudulently (creating fake accounts, using fake phone numbers, paying for installs in violation of platform rules).
- Reverse-engineer or decompile any portion of the Service.
Violations may result in account termination and loss of any coin balance.
6. Intellectual Property
All Content available through the Service — including videos, scripts, music, and graphics — is owned by us or our licensors and protected by copyright and other intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view Content on the Service for your personal, non-commercial use only.
You may not: - Copy, record, download, or distribute Content from the Service. - Use Content in any derivative work, training data, or other reuse. - Remove any copyright or proprietary notices from Content.
7. User Content
If you submit any feedback, suggestions, or comments to us, you grant us a royalty-free, worldwide, perpetual, non-exclusive license to use that feedback to improve the Service without compensation or attribution.
8. Service Availability and Changes
We may modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the Service.
We do not guarantee that the Service will be available without interruption, error-free, or completely secure.
9. Termination
You may delete your account at any time via the in-app account settings. Upon deletion: - Your account and personal information will be deleted per our Privacy Policy. - Any remaining coin balance will be forfeited. - Pending referral rewards will not be granted.
We may suspend or terminate your account if you violate these Terms, with or without prior notice.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MARKEY, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) $50.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless MarKey, J.T. & Son's Development Group, and our affiliates and personnel from any claim arising out of: - Your use of the Service. - Your violation of these Terms. - Your violation of any rights of a third party.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-laws principles.
Informal Resolution. Before filing a claim, you agree to try to resolve the dispute by contacting us at support@markeysocial.app. We will try to resolve it within 30 days.
Arbitration. Any disputes that cannot be resolved informally will be resolved through binding arbitration in York County, Pennsylvania, before a single arbitrator, in accordance with the Commercial Arbitration Rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action.
Exceptions. Either party may bring an individual action in small-claims court for any qualifying claim.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via in-app notice or email at least 7 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

16. Apple App Store Additional Terms
If you use the Service via Apple App Store, you acknowledge that: - These Terms are between you and J.T. & Son's Development Group, not Apple. - Apple is not responsible for the Service or its content. - Apple has no obligation to provide maintenance or support for the Service. - If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation. - Apple is a third-party beneficiary of these Terms and may enforce them against you.
17. Google Play Additional Terms
If you use the Service via Google Play, you acknowledge that your use is also subject to Google Play's Terms of Service.
